Probate & Estate Planning : Your Top Questions Answered

    Q
Should you take out a grant of probate?
A A grant of probate is a document that states that you are legally allowed to settle the estate of someone who has died.

A grant of probate is not always required: if the total value of the estate is small, or accounts, property and assets were owned jointly, you can potentially settle the estate without one.

    Q
    Should you make a will?
A By making a will, you control who it is that benefits when you die. If you do not make a will, the intestacy rules will apply.

These will decide who benefits from your death. So if you don’t make a will, a relative that you don’t get along with will be equally entitled to take a share in your estate. You will also decide who it is that is responsible for looking after your affairs. This can avoid unnecessary conflict amongst family members.
